Lawsuit settlement by a former Sophia police officer in the works

SOPHIA - A lawsuit against the Sophia Police Department and Chief Tomi Peck is being settled by a former police officer who said he was fired because he's black.

U.S. District Judge Irene Berger dismissed Damon McDowell's lawsuit this week after a mediator reported that he'd negotiated a settlement.  McDowell's attorney, Maria Hughes, said the terms are confidential.  

Peck said she fired McDowell last year after he left a Beckley restaurant without paying the bill.  

McDowell Claims he was the victim of harassment schemes aimed at forcing him to resign that included hiding paperwork so he's miss court appearances and telling jokes with racial epithet in his presence.  He was fired just after six months on the job.
